{"id":220,"date":"2015-11-18T16:18:02","date_gmt":"2015-11-18T15:18:02","guid":{"rendered":"http:\/\/www.avocat-vdb.be\/_new2015\/en\/?p=220"},"modified":"2015-11-25T14:35:57","modified_gmt":"2015-11-25T13:35:57","slug":"draft-law-of-20072011-concerning-the-creation-of-the-family-and-childrens-court","status":"publish","type":"post","link":"https:\/\/www.avocat-vdb.be\/en\/draft-law-of-20072011-concerning-the-creation-of-the-family-and-childrens-court\/","title":{"rendered":"Draft law of 20\/07\/2011, concerning the creation of the Family and Children&#8217;s Court"},"content":{"rendered":"<p>The law of 30\/07\/2013, concerning the creation of a family and children&#8217;s court, was published in the Moniteur Belge on 27\/09\/2013.<\/p>\n<p>Composition of the Family Court<\/p>\n<p>The family and children&#8217;s court will be a section of the court of the first instance, and this section will be divided into 3 sub-sections:<\/p>\n<ul>\n<li>the family court to which civil litigation will be submitted;<\/li>\n<li>the children&#8217;s court to which protective disputes relating to minors will be submitted;<\/li>\n<li>one or more chambers for amicable settlement of disputes.<\/li>\n<\/ul>\n<p>Competence of the Family Court<\/p>\n<p>The family court will be competent to decide on applications:<\/p>\n<ul>\n<li>relating to the status of persons;<\/li>\n<li>from spouses and legally cohabiting partners, relating to the exercising of their rights or their property;<\/li>\n<li>relating to parental authority;<\/li>\n<li>relating to the custody of minor children;<\/li>\n<li>concerning maintenance obligations (excluding social integration income);<\/li>\n<li>concerning disputes connected with family allowances;<\/li>\n<li>relating to matrimonial property schemes;<\/li>\n<li>relating to inheritance;<\/li>\n<li>relating to gifts and distribution.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>The law of 30\/07\/2013, concerning the creation of a family and children&#8217;s court, was published in the Moniteur Belge on 27\/09\/2013.
